Rape Inequality

Over in Oklahoma, 44-year-old first grade school teacher Tasha McCuan had sex with three different underage high school boys (link). The state charged her with three counts of second-degree rape. I’m sure she only had sex with them once each. True to form, the state then gave her the pass and dropped two of the three charges. For rape of three boys one boy she gets 5 years in prison and a $2,200 fine.

Around the same time as Tasha was getting it on with every boy at the high school, 36-year-old high school teacher Jason Argo was starting his 12-year prison sentence for one count of lewd battery and one count of child abuse, after receiving oral sex twice and having intercourse once with a high school student.

It turns out that Argo got off easy—12 years—because he had PTSD. On the other hand, McCuan got off easy5 years—because she’s a woman.

    I’m not a lawyer or play one on tv…but what’s a blind plea? Is that another term for ‘she’s a woman so let’s not give her the same justice as a man’?

    HOWEVER, it seems that, despite teaching primary school, she was banging high school boys.

    By high school boys, it’s safe to assume that these were young men of 14-18.

    Am I a white-knighting faggot mangina to note a difference between banging a well-developed 16-year old man, and sucking off an eight year old little boy? Maybe… Of course, I remember my own proclivities in high school. I never fucked any faculty when I was that age, but there were a few hot bitches employed there that I surely would have plowed, if fate had offered me the opportunity. Granted, this old bag probably wouldn’t have made my cut, but who knows?

    One of the (few) places I agree with modern feminist theory is in this general area. If you’re teaching someone something, you shouldn’t be fucking him or her, if only because the rest of the students will feel like you’re favoring someone for reasons other than scholastic performance. But, these men weren’t little tykes in her first-grade classroom. They were grown men, who, only a couple of generations ago, would have been married fathers with young children at their ages…

    Boxer, this is why I chose two teachers who had sex with teenagers for this compare and contrast. We can argue whether the age of consent should be dropped, but it’s irrelevant to my point. I’ve illustrated the inequality perfectly.

    The man was not a serial offender: he only had sex once with one girl (age 15) who was his student. By contrast, the woman went out of her way to find high school students and made a habit of it: having sex with three teens. He suffered from a mental illness, she did not. But earl noted perhaps the most salient point:

    A blind plea is when you plead guilty without a corresponding predetermined sentence. You are throwing yourself on the mercy of the judge. It is incredibly risky and irrevocable and you wouldn’t do it unless you had a strong notion that you would be shown leniency. More than likely the prosecution had enough evidence to put her away on 3 counts and offered her a lousy plea deal. She didn’t take it, relying on the judge to go soft on her, which happened. She was facing 3-45 years and got 5.

    Let’s see if your feminist take is logical by examining other related situations involving those legally allowed to consent in situations where there is a conflict of interest. What if a woman has sex with her boss? We all know that this sort of thing happens quite frequently without any fines or jail time. When consenting adults consent to having sex, even when there could be a conflict of interest, it isn’t automatically a crime. Even when it is, the remedy may be merely a fine and/or a firing.

    I would argue that these are poor comparisons, because the second teacher had sex with a girl that was his student, and the first teacher never had sex with any of the boys in her class.

    I actually think five years is a pretty fair sentence for having sex with teenagers, particularly if they were 14-year old men, rather than 18-year olds. I certainly think that there’s an ethical lapse for having sex with someone you’re managing at work, as well. I have worked at places where I have wished that the idiots who were constantly having sex could be jailed. You’re there to perform for your boss. It ain’t a fuck’n night club.

    As for sex with your teacher or just a teacher at the school. IDGA(flying)F .. you are in a position of power. You have a responsibility to a higher standard .. PERIOD. No discussions about it.     You could, but it’s not a valid legal argument:

    I do agree that 5 years is a reasonable punishment for the crime. It might technically be on the low side considering three different children were raped, but my political stance favors a criminal justice reform that results in lighter sentences for most crimes. It’s about inequality, not justice:

    Men are simply not afforded the same pass that women are for the exact same crime. Honeycomb’s point is correct:

    The solution isn’t to widen the age of consent. All sex outside of marriage (with a loose definition of marriage) should be condemned. At no point can either age or consent make fornication an objectively good thing. Whether it is outlawed or not is for society to decide, but it would probably be better if it did.

    Jesus, this is histrionic. High school kids aren’t children, and in most cases, they’re over the age of consent. I doubt these 40-something doughballs had the strength to rape anyone, including 16-year old men and women in their prime (lol).

    One got five years, the other got twelve. They’ll probably both be out in two. Such is our modern liberal circus.

    The problem, as I see it, is in parents sending off Johnny and Janie to school, thinking he and she are getting educated by qualified people, when they’re really dating and having sex with said adults. It’s a professional environment. It’s not a place to find dates and hookups, and I have zero sympathy for either of these cretins. I’m sure they were a total embarrassment to all their colleagues. Glad they’re both in the clink.

    So what? Because I’m not making a moral argument. Women get a legal pass on sentencing, resulting in significant disparity. Women are treated fairly, men are not.

    Let’s consider the application of historical moral standards to this situation. The young men would be able to have sex with the older non-virgin woman if they so chose. By contrast, older men would not be permitted to have sex without young virgin women without first obtaining permission from her father and payment of the bride price. Of course they’d be married at that point.

    You can argue that under those standards McCuan should get off easy and Argo should be punished more severely, but we don’t live in that kind of society. Daughters are not subject to their father’s oversight and they don’t have to marry in order to have sex. It’s not clear how you can partially apply patriarchal moral standards in this situation. If you do, you get feminism, not patriarchy: it’s about sexual liberation, not family and society.
